These Terms of Use govern your access to and use of Kaish, including the Kaish app, Kaish Capture, the website, and related services. By using Kaish, you agree to these terms.

Use of the Service

You agree to use Kaish only for lawful purposes and in a manner that does not interfere with the operation of the service or the rights of others. You are responsible for the activity that occurs under your account.

Accounts

You may need an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Your Content

You retain ownership of the content you create, record, upload, import, or organize in Kaish, including videos, tagging data, capture session data, playlists, coach clips, presentations, and related materials. You grant Kaish the limited rights necessary to host, store, process, display, and transmit that content solely to provide and improve the service.

Subscriptions and Billing

Paid plans may renew automatically unless canceled before the renewal date. Pricing, trial terms, plan features, and subscription details may be presented in the app, on the website, or on the purchase screen at the time of signup or renewal.

Feature Availability

Features may vary by plan, device, operating system, or release stage. Some functionality may be offered only in beta, on selected platforms, or in higher service tiers. Kaish may modify, improve, add, or remove features over time.

Acceptable Use

You may not use Kaish to violate applicable laws, infringe intellectual property rights, interfere with the service, attempt unauthorized access, or upload malicious code or harmful content.

No Guarantee of Outcomes

Kaish provides tools for video capture, tagging, coaching, review, and presentation. Kaish does not guarantee athletic, competitive, business, recruiting, or coaching outcomes resulting from the use of the service.

Availability

Kaish aims to provide a reliable product, but uninterrupted access, error-free operation, and ongoing availability of every feature are not guaranteed. Planned maintenance, updates, third-party service interruptions, or technical issues may affect access from time to time.

Intellectual Property

Kaish and its related branding, software, design, and service elements are protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, reverse engineer, distribute, or create derivative works from Kaish itself.

Termination

Kaish may suspend or terminate access to the service if these terms are violated, if required by law, or if continued access creates security, operational, or legal risk.

Disclaimer

Kaish is provided on an “as is” and “as available” basis without warranties of any kind, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Kaish will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business opportunities arising from your use of or inability to use the service.

Changes to These Terms

Kaish may update these Terms of Use from time to time. If material changes are made, Kaish may update the effective date and provide notice through the website, app, or other appropriate channels.
